Illness can be a cover-up for custody refusals

When you have custody of your child and they fall ill, the last thing you want to do is send them to the other parent's house. Besides the fact that you could make the other parent sick by sending your child with an illness, you don't want to disrupt your child while sleeping or recovering.

In most cases, people are considerate in these situations. If your child is sick at either home, the other parent generally understands and adjusts custody arrangements for that day or until their child recovers.

There can be a problem, however, if a parent is constantly refusing visitation or custody exchanges because of a child's alleged illness. The reality is that if a child is constantly sick, they should be seen by a medical professional, and there should be documentation. All too often, it's a parent who has decided to restrict visitation using "sickness" as a barrier.

What can you do if you believe the parent is restricting custody or visitation using "sickness" as a reason?

If this doesn't happen often, the likelihood is that your child is actually ill. In that case, it's usually best to allow your child to recover wherever they are or wherever they'll have a parent there to care for them if they're too sick to travel. However, if this is happening time and time again, it's appropriate for you to start asking questions. You can also ask to go to the other parent's house to check on your child and verify the illness. If refused, you may wish to reach out to your attorney for further assistance.
